We know that the privacy of personal information we receive about you is important to you. We understand that you trust us to protect the confidentiality and security of that information. Information we obtain about our clients, or those with a relationship of some kind with our clients, or in connection with acting as a title insurance agent, is used only to provide the legal and related services requested by our clients or as is necessary given the nature of the matter involved. Although federal law is designed to protect the privacy of such information, as attorneys we are bound by professional standards of confidentiality which may be more stringent than those required by federal law. This notice informs you of our privacy policy and describes how we treat information we receive about you.

Information We Receive About You

We may receive nonpublic personal information in connection with circumstances described above. The types of nonpublic personal information we receive vary according to the services we perform and may include, for example:

  • Information about clients or about persons with business or other relations with our clients (such as, for example, names, addresses, income, assets, social security information, and other financial or household information);
  • Information about a client's relationship with the firm and past history with us and others (such as, for example, the types of legal services provided to a client, invoice balances and payment history); or
  • Information we receive from third parties such as, for example, accountants, financial advisors, insurance agents, banking institutions and others.

How We Treat Personal Information

We do not disclose any public or nonpublic personal information about clients, or those with a relationship of some kind with our clients, or in connection with acting as a title insurance agent, to unaffiliated third parties except as authorized by the client or by law or as is necessary given the nature of the matter involved. For example, we may disclose certain information to a lender or other third-parties, such as, for example, an appraiser or accountant, which are assisting us in providing services to you. We do not disclose, sell, or rent any such information to any other third party, unless approved by you or required by law. While federal laws and regulations establish rules and disclosure requirements, they do not limit the attorney-client privilege or the confidentiality rules for information provided to attorneys by their clients. The privilege and confidentiality rules are governed by Florida law, the rules imposed on attorneys under Florida law, and our ethics standards. In circumstances where applicable federal laws would permit disclosure, we will continue to follow the non-disclosure rules of attorney-client privilege and client confidentiality. Please note that, although we aim to protect your personal information against unauthorized disclosure, we cannot guarantee that your personal information will never be disclosed in a manner inconsistent with this policy.

How We Protect Your Information

We restrict access to public and nonpublic personal information about clients, or those with a relationship of some kind with our clients, or in connection with acting as a title insurance agent, to our affiliates and to those attorneys and staff members in our firm who need to know the information to provide the requested services. All of our attorneys and employees are required to maintain the confidentiality of all nonpublic personal information about clients, or those with a relationship of some kind with our clients, or in connection with acting as a title insurance agent. We maintain physical, electronic, and procedural safeguards which comply with both federal law and our professional standards to protect clients' public and nonpublic personal information.

Effective Date

The effective date of this Privacy Policy is November 1, 2008.
